Background and Aim: In any legal system, criminal liability is rooted in the anthropological teachings on which that legal system is based. According to the anthropological ideas of Islam, the position and rank of human beings are different according to their possessions and talents; In such a way that no two human beings can be found to enjoy the same conditions.
Method: The present study is applied in terms of purpose. The research method is descriptive-analytical and the research data were collected using library resources related to the subject.
Results and conclusion: From the Islamic point of view, everyone is responsible for their surroundings and has not been oppressed. The religion of Islam, while holding man responsible for all these differences, has taken a different approach to the issue of criminal liability and recognizes all these differences and holds everyone responsible for his actions in proportion to what he has; Therefore, due to the differences between human beings, the degree of their criminal responsibility will be different, so criminal liability in Islam is a relative concept that will fluctuate towards different people.
